(Excerpt from the Law on Civil Servants)

When filling an executive position, preference is given to the transfer of a civil servant from the same state body, with or without promotion.

If the position is not filled by transfer, the manager can carry out the procedure of taking over the civil servant from another state body.

If the manager decides not to fill the position even with a transfer based on the takeover agreement, an internal competition can be conducted, and if the internal competition has not been conducted or failed, a public competition must be conducted.

If the public tender is also unsuccessful, the position is not filled, but the manager may decide to re-implement the procedure for filling the position according to the sequence of actions prescribed by the provisions of this article.

The public competition is advertised by the state administration body that fills the position on its website, on the website of the Personnel Management Service, on the e-government portal, on the notice board, on the website and in the periodic publication of the National Employment Service advertisement.

The public competition is conducted by the competition committee appointed by the manager, applying the provisions of this law on the appointment of the competition committee for the implementation of the internal competition.

If the position is filled by the Government, the members of the competition committee are appointed by the High Civil Service Council for each individual case.
