Positive opinion of the Venice Commission on the new set of judicial laws

Minister of Justice Maja Popović participated in the work of the 132nd plenary session Venice Commission, at which an opinion was adopted on the working texts of the Law on the Organization of Courts, the Law on Judges and the Law on the High Council of the Judiciary.

The adopted positive opinion indicates that the judicial laws, together with the changes to the Constitution that the citizens of Serbia recently confirmed in the referendum, have the potential to lead to significant positive changes in the Serbian judiciary and that the working texts of the laws are well structured, clearly written and include all essential points which should be covered.

Emphasized is that the further improvement of the judiciary depends mostly on a solid legislative framework, which will ensure that the independent judiciary and the independent public prosecution enjoy a high reputation in society and are oriented towards the future.

The Venice Commission praised the Ministry of Justice for its significant efforts in the preparation of judicial laws, as well as for inclusiveness and transparency preparation process of the law and pointed out that she should continue the process of passing laws in the same spirit, with provision public consultations in the coming months which will precede voting on laws in to the National Assembly.

In its opinion, the Venice Commission made recommendations that the Ministry of Justice will consider in detail and implement into the texts of laws those recommendations that are in the best interest of the legal order of the Republic of Serbia.
